On May 25, 2018, the new text on personal data protection will come into force.
It will impact all websites and all people located on European Union soil.
But what exactly is the RGPD?
We’re talking about the new reference text, the General Data Protection Regulation (GDPR).
This now requires the implementation of appropriate measures necessary to ensure that all processing of personal data, whether automated or not, benefits from an appropriate level of security.
The aim is to strengthen people’s rights.
When does the RGPD apply?
This new text applies if :
- Your company has an establishment in the European Union
- Personal data belongs to people located within the European Union, even if your company does not have a presence there.
Personal data includes any information about an individual that enables that person to be identified, either directly or indirectly.
Surname, first name, telephone number, e-mail address, IP address… are all part of personal data.
A precise definition is already given in the 1978 Data Protection Act, which stipulates: “any information relating to a natural person who is identified or who can be identified, directly or indirectly, by reference to an identification number or to several elements that are specific to him or her”.
